Notification - Rescheduling of agricultural loans

Dear clients,

We would like to inform you that on October the 8th, 2022. Decision on temporary measures for banks for the purpose of adequate credit risk management in the portfolio of agricultural loans in conditions of difficult agricultural production came into force ("Sl. glasnik RS", No. 111/2022, hereinafter: Decision), which prescribes measures and activities for banks in order to adequately manage credit risk in the portfolio of loans granted to debtors for the purposes of performing agricultural activities (hereinafter: credit) in conditions of difficult agricultural production, by providing reliefs for the repayments of clients liabilities (hereinafter: client or debtor).

Pursuant to the Decision, HALKBANK a.d. Belgrade (hereinafter: Bank) is obliged to grant its clients - at their request, a loan rescheduling in accordance with the Decision, if all the following conditions are fulfilled on May 31st, 2022:

1. Client is not in delay for more than 90 days on any obligation to which the reprogramme applies;

2. Client is not in the status of non-payment of liabilities to the Bank, in terms of the regulations of the National Bank of Serbia;

3. No receivables from the client were classified as problem loan in the bank, i.e. problematic claims in the sense of the regulations of the National Bank of Serbia.

4. Credit according to this decision means loans approved for the purposes of performing agricultural activities.

5. The date of realization of the loan for which the client submits a request for reprogramming cannot be after the entry into force of this decision, i.e. 07.10.2022

 

Pursuant to the Decision, the debtor is a person who is registered in the register of agricultural holdings in terms of the law governing agriculture and rural development (hereinafter: Register):

a. Individual who is the owner of a commercial family agriculture household within the meaning of the law governing agriculture and rural development;

b. Entrepreneur;

c. Legal entity:

- an agricultural cooperative with at least 5 members who are registered in the Register as holders or members of 5 different agricultural holdings registered in the Register,

- other legal entity classified as a micro or small legal entity in accordance with the law regulating accounting.

Reprogramming can be applied to client obligations based on loans approved under the guarantee scheme of the Republic of Serbia or with a guarantee from international financial institutions, as well as on the basis of subsidized loans, only with the prior consent of the providers of that guarantee or subsidy.

Loan reprogram is a change of the conditions of an individual loan so that the client is provided with a grace period in repayment of all client’s liabilities to the Bank under that specific loan for a period of six to twelve months (depending on which period the client chooses in his request), during which the Bank does not collect the principal, but it collects the agreed interest. The repayment period of that loan will be extended so that the amount of the annuity (periodic obligation that would be paid after the end of the grace period) determined at the time of approval of the reprogram will not be higher in relation to that amount in the period before the application of reprogram.

 

The client has the possibility to use the reprogram for one or more types of Loans.

Client obligations related to fees for the Bank's services, such as payment services (e.g. transaction fees, account maintenance fees), investment services, broker-dealer operations, safe deposit boxes services, etc. are not the subject of the Decision and cannot be subject of the approval of reprogram.

Loan repayment terms agreed upon by approving the relief (e.g. interest rate, additional collateral, etc.) cannot be less favorable for the client than the originally, earlier agreed terms.

 

Client request

 

The client can submit a request to the Bank no later than April 30th, 2023. The Bank's recommendation is that requests should primarily be submitted by e-mail.

The client has the option of choosing the length of the grace period from 6 to 12 months.

The request is submitted by the client or the client's legal representative, in one of the following ways: • electronically to the e-mail address agro.olaksice@halkbank.rs

• electronically through the contact form on the Bank's official website;

• in the Bank's business premises to the competent credit officer;

• by mail to the address of Milutina Milankovića 9e, with the indication "Reprogram for agriculture household

The Bank shall decide on the client's request and notify the client of that decision within 30 days from the day of receipt of the valid request. If the reprogram is approved in accordance with the Decision, it is considered that the delay in the settlement of the client's liabilities to the Bank based on the loan being reprogrammed has been stopped on the day the request is submitted, and the client's delays to the Bank are determined according to the new agreed repayment plan.

The Bank cannot charge a fee for taking measures and activities in accordance with the Decision, as well as the costs it may have related to undertaking measures and activities, including the costs for processing the client's request, except for costs necessary for the approving receivables not determined by the Bank (e.g. credit bureau or real estate cadastre).
